Clarifying Plan Amendment

To All Eligible Participants and Dependents:

Effective April 1, 2003, the Plan has been amended to align Plan language with administrative practice with respect to continuation of coverage for the surviving spouse and dependent children of deceased participants. Upon the death of a participant, his surviving dependents' eligibility is continued until his accumulated eligibility (bank of hours), if any, is exhausted. After that, his surviving spouse may continue coverage for herself and the surviving dependent children (as defined by the Plan) by making self-payments. This coverage is provided under the Retiree Program.

The privilege to continue coverage by making self-payments terminates on the day:

  1. the surviving spouse remarries
  2. the surviving spouse and/or dependent children become eligible for benefit coverage from another group health care plan by reason of employment (regardless of whether or not they actually do participate in such plan)
  3. - OR -

  4. the surviving spouse and/or dependent children establish residence outside of the United States.

Please note that the dependent children are not eligible to continue coverage by making self-payments independently of the surviving spouse (except to the extent they are eligible for and elect COBRA continuation coverage).
